TERMS OF USE

These Terms of Use set forth the legal rules and conditions governing your access to and use of KCLUB’s services. By creating an account or continuing to use the website, you acknowledge that you have read, understood, and agreed to be bound by all of the terms below. If you do not agree with any part of these Terms of Use, please discontinue using our services immediately.

1. Eligibility Requirements

Age Requirement: The platform is strictly available to users who are at least 18 years of age. You must ensure that you have reached the legal age of majority under applicable laws before registering and participating in any betting activities. We reserve the right to request proof of age and identity at any time. Any deliberate misrepresentation of age or identity constitutes a violation of these Terms and may result in permanent account termination.

Jurisdiction and Legal Compliance: You are solely responsible for ensuring that your participation in Kclub does not violate any laws or regulations applicable in your jurisdiction. Our services may not be available in certain countries or territories. We do not provide services in prohibited markets or jurisdictions subject to sanctions under Curaçao regulations and international law. If it is determined that you are accessing the platform from a restricted territory, we reserve the right to deny service and close your account.

Single Account Policy: Each player is permitted to register and maintain only one (1) account on Kclub. All accounts must be registered using accurate, complete, and truthful personal information belonging solely to the account holder. Creating multiple accounts or providing false or misleading information (including but not limited to name, identification documents, address, or email) is strictly prohibited. If such fraudulent behavior is detected, all related accounts may be suspended or terminated, and any bonuses or winnings derived from such violations shall be forfeited.

Compliance with Other Rules: By using our services, you agree to comply with all rules, regulations, and policies established by Kclub, as well as all applicable laws. This includes compliance with game rules, betting limits, payment regulations, and all other operational guidelines in effect. Any violation may result in disciplinary actions ranging from warnings to suspension or permanent termination of the account, depending on the severity.

2. Rights and Responsibilities of Players

Account Security: You are responsible for maintaining the confidentiality of your login credentials, including your username and password. All activities conducted through your account shall be deemed to have been performed by you. You must notify us immediately if you suspect any unauthorized access. Kclub shall not be liable for any losses or damages resulting from your failure to safeguard your account credentials.

Accuracy of Personal Information: You represent and warrant that all information provided during registration and throughout the use of the services is true, accurate, and complete. You are responsible for promptly updating your information in the event of any changes (e.g., email address, phone number, or payment details). Providing inaccurate or misleading information may result in delayed withdrawals or account suspension at our discretion.

Compliance with Game Rules: When participating in betting and gaming activities on Kclub, you must comply with the rules applicable to each game or product. It is your responsibility to familiarize yourself with the relevant rules before participating. All betting decisions are made at your own discretion and risk. You acknowledge that all wins and losses are solely your responsibility, and Kclub shall not be liable for any losses incurred as a result of your betting decisions.

Prohibited Conduct: Any form of fraud, collusion, or abuse of the platform is strictly prohibited. Prohibited activities include, but are not limited to: the use of automated betting tools (bots), manipulation of game outcomes, exploitation of system vulnerabilities, money laundering, or match-fixing. Players are also prohibited from transferring, selling, or renting accounts to third parties. Upon detection of any violation, we reserve the right to immediately freeze or terminate the account and confiscate any bonuses or winnings obtained through such misconduct.

Community Interaction: When using interactive features (e.g., live chat, forums, comments), you must comply with our Community Rules. Absolutely prohibited are vulgar, harassing, hateful, discriminatory, or unlawful content. Always maintain a respectful attitude towards others. If you witness a violation by another member, please notify us through the support channel.

3. Rights and Responsibilities of Kclub

Right to Verification & KYC: Kclub reserves the right to request you to provide additional information or documents for account verification (following the KYC – Know Your Customer procedure) at any time. This may include photographs of ID card/Citizen Identification Card/Passport, proof of address, verification of payment methods, etc. We comply with KYC and anti-money laundering regulations as required by Curaçao and international standards. During the verification period, we may temporarily suspend some functions (such as withdrawals) until the verification process is complete.

Maintenance and Service Interruption: Kclub strives to ensure stable, continuous service operation but cannot exclude the possibility of interruptions due to system maintenance or unforeseen issues. We reserve the right to temporarily suspend access to the website or servers for maintenance, upgrades, or technical troubleshooting. In this case, we will notify as soon as possible on the homepage or appropriate communication channels. Kclub shall not be liable for any indirect losses resulting from service interruptions, but will make every effort to restore operations and preserve customer data and account balances.

Transaction Management: We have the right to set appropriate financial transaction limits, including minimum/maximum limits for each deposit, withdrawal, betting limits, etc., to ensure compliance with legal regulations and financial risk management. Any unusual deposit/withdrawal transaction (e.g., sudden large amounts, suspicious source of funds) may be delayed for additional inspection. Pursuant to Anti-Money Laundering (AML) obligations, we will monitor and report suspicious transactions to the relevant authorities.

Refusal or Termination of Service: Kclub reserves the right to refuse to open an account or provide services to any individual who does not meet the conditions of use (e.g., underage, from a prohibited area, providing false information). We also have the right to suspend or terminate a player's account if there is evidence of violation of these Terms of Use, violation of law, or any behavior that harms the system and the player community. Before locking the account, we will attempt to contact you and inform you of the reason (unless the law requires immediate lock). The available balance in the account (after deducting any bonus amounts involved in violations or funds related to fraudulent behavior) will be processed according to the current Withdrawal Policy or as directed by the regulatory authority.

Intellectual Property Rights: All content, interfaces, software, and resources on Kclub are owned by us or our licensors. We are responsible for protecting our and our partners' intellectual property rights, and will strictly address violations (see more in the DMCA & Intellectual Property Policy). We reserve the right to remove any content that violates copyright or posting regulations without prior notice.

Changes to Terms: Kclub reserves the right to amend or supplement these Terms of Use at any time if necessary. When there are significant changes, we will notify on the website and/or via the player's registered email. Your continued use of the services after the changes take effect signifies acceptance of the updated terms.

4. Deposit and Withdrawal Transactions

Legal Source of Funds: Players must ensure that all funds used to deposit into the Kclub account originate from a legal source and are owned by you. The act of depositing funds using another person's card/bank account without permission, or depositing from sources related to illegal activities, is strictly prohibited. Kclub may request proof of fund origin or ownership of the payment method at any time.

Deposits: When you wish to deposit funds into your account, please follow the instructions on the Deposit page of the website. We support many popular payment methods (e.g., bank transfer, e-wallets, international payment cards, cryptocurrencies, etc.). All bank/transfer account information will be provided clearly; players should contact Customer Support if official deposit information needs confirmation. The deposited amount will be credited to the balance after the transaction is successfully confirmed. Note: Kclub does not charge a deposit fee, but the payment service provider may charge fees according to their regulations (if any).

Withdrawals: Before withdrawing funds, the player must complete at least one betting round with the deposited amount (or meet the required betting turnover conditions of the promotion program, if applicable). The minimum and maximum withdrawal amounts per transaction will be specified on the Withdrawal page. We allow players to withdraw funds through methods similar to deposits. Each day, an account can withdraw funds with free processing fees for a certain number of times (e.g., the first 3 times); from the fourth time onwards in the day, a 5% processing fee may be applied to the withdrawal amount – details of any fees will be announced before you confirm the withdrawal order.

Processing Time: Withdrawal requests will be reviewed and processed by us as quickly as possible. The usual maximum processing time is 24 hours from the moment you submit the request (excluding interbank transfer time). However, the majority of withdrawal transactions will be completed within a few hours if there are no issues. In case of abnormal delays (exceeding 24 hours) or a need for additional verification, we will notify you via account message or email. The player is responsible for providing accurate information for smooth withdrawal processing.

Freezing of Suspicious Transactions: For security and legal compliance reasons, Kclub reserves the right to temporarily suspend or refuse a withdrawal request if signs of fraud or violation of the Terms are detected. For example, if there is suspicion that you are abusing bonuses, using multiple accounts, or engaging in suspicious transactions, we will temporarily freeze the related funds and initiate an investigation. After the verification process, if you are determined not to be in violation, the funds will be released for withdrawal. Conversely, if a violation is found, we may confiscate bonuses, winnings, and apply appropriate penalties (including account lock if necessary).

5. Disclaimer and Limitation of Liability

Player's Risk: You understand that participating in online betting and games on Kclub is random in nature. The player is solely responsible for the results of wins/losses and financial risks when participating in betting. We do not guarantee that you will win in any game or bet, and will not be liable for any losses or personal financial damages arising from your betting activities.

Disclaimer of Service Warranties: Kclub provides services and content “as is” and “as available”. We make no express or implied warranties that the service will fully meet your requirements, or that the service will be uninterrupted or error-free. Although we strive to maintain the highest accuracy and reliability of information (e.g., match results, statistics, promotional information...), we do not absolutely guarantee freedom from errors. Kclub will not be legally liable for errors or temporary service interruptions, except where otherwise provided by law.

Limitation of Liability: To the extent permitted by law, Kclub's liability (if any) for any claim for compensation from a player shall be limited to the lower of: (a) the amount you have paid to us (e.g., service fees) within the last 6 months, or (b) a specific amount determined by law. We shall not be liable for any indirect, incidental, special, or consequential damages (including loss of data, loss of revenue, loss of opportunity, etc.) arising from the use or inability to use the services, even if we have been advised of the possibility of such damages.

Force Majeure: Kclub shall not be liable for delay or failure in performance of its obligations under these Terms if the cause arises from events beyond our reasonable control. This includes but is not limited to: natural disasters, fire, flood, war, riot, power or telecommunications failure, cyberattacks, failure by third-party service providers, or legal regulations/government actions that disrupt the service. In case of force majeure, we may temporarily suspend the service and will endeavor to notify and rectify the situation as soon as possible.

Links and Third-Party Content: The Kclub website may contain links to third-party websites or resources (e.g., links to game providers, payment methods, or partner advertising pages). These links are provided solely for your convenience. We do not control and are not responsible for the content, policies, or actions of any third-party websites. Your access to such links is voluntary and at your own risk. We recommend that you review the separate terms and policies of the third party when leaving our website.

Indemnification: You agree to indemnify and hold Kclub, its parent company, affiliates, and our employees, management, and partners harmless from all liability for claims, losses, damages, costs (including reasonable attorney's fees) arising from your violation of these Terms of Use or violation of law during the use of the services. This means that if your actions cause a legal dispute or damage to us, you must be responsible for resolving and compensating us for the related costs.

Reservation of Legal Rights: If any provision in these Terms of Use is declared void or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce a certain provision does not mean that we waive our right to enforce that provision in the future. All other rights permitted to us by applicable law are fully reserved.
